I DO , I DO

Such a crazy morning/afternoon in such a good way!


Marriage Equality moved one step closer to the Supreme Court on Tuesday when the 9th court of appeals ruled California's Prop 8 unconstitutional, stating " it serves no purpose other than to "lessen the status and human dignity" of gays. A three-judge panel of the 9th U.S. Circuit Court of Appeals gave gay marriage opponents time to appeal the 2-1 decision before ordering the state to allow same-sex weddings to resume. The one dissenting judge was a Mormon.

A quicker than quick micro readers digest history lesson. 

The California legislature twice passed a marriage equality law, both times to be vetoed by Arnold. Acting on his own, Mayor Gavin Newsom just started marring couples which sort of got the ball rolling for the California Supreme Court to rule that denying marriage to all Californians was illegal and starting on June 16th 2008 gay and lesbian couples could get full blown married. Election night '08 ushered in President Barack Obama AND Prop 8, which changed the California constitution to make marriage one man one woman.
Two couples Paul Katami - Jeffrey Zarrillo and Kristin Perry - Sandra Steir sued, and on August 4, 2010, now retired Federal judge Vaughn Walker ruled that Prop 8 was unconstitutional. CELEBRATE!
Yeah, not so fast.. While all this was going on, Arnold was out and Jerry Brown was in and no one in the state government wanted to stand for the state in the case, so the California Supreme Court had to come back in and say who could be against the case being overturned, since the Governor nor Attorney General wanted too....
At last to the 9th Circuit court and TODAY, they ruled... UNCONSTITUTIONAL!

The Mormons and Latin Mass Catholics can not either go before the entire 9th circuit or try and go straight for the Supreme Court.

Now the ruling was LASER BEAMED in on Supreme Court precedent, mostly in the case of Romer v Colorado (Evans ) in which the Supreme Court ruled that gays and lesbians could not be singled out .. for anything, just for being gays and lesbians. Which is the only standing that the Prop 8 case was built on. California has full Civil Union laws, and only the word marriage is denied same sex couples...
Some folks are saying it is too limited a ruling , just on the Prop 8 case and the single event of rights being taken away from citizens in California,others are saying its a very sweeping ruling that will have an affect all over the country. I am not sure, I will keep reading and working my findings out here on the blog for any intrested.
WHAT I DO KNOW, is my side won this morning, big time...
We as a country are one step closer to , at long last, ALL men being created equal.
