TODAY IN GAY



Ok, I did not write about the 6th circuits big NO ruling last week because it kind of got lost in the great red tsunami that came down on Tuesday and I just went under. ( I'm back now and fine  ) One thing that I thought was that the one NO vote would put all the other rulings on hold because unlike all the pro marriage equality rulings, this one IS going to go to the SCOTUS ( there is still the step of taking the ruling en banc - that is take it before ALL the judges in the 6th circuit which could keep the case away from the Supremes )


Well I was wrong and the other courts are not waiting for the SCOTUS to weigh in. This morning we got this

A federal judge ruled Wednesday morning that South Carolina officials cannot enforce the state's gay marriage ban, although a temporary stay means those marriages will not happen any time before Nov. 20. U.S. District Judge Richard Gergel granted a motion for summary judgment and enjoined any state official from enforcing the state's constitutional gay marriage ban or not allowing same-sex couples marriage licenses. However, Gergel also granted defendants Gov. Nikki Haley and Attorney General Alan Wilson a temporary stay until noon on Nov. 20. Charleston County Councilwoman Colleen Condon and her partner, Nichols Bleckley, sought the preliminary injunction to prohibit state officials from enforcing South Carolina's constitutional ban on same-sex marriage. They contend the state must allow the marriages following the U.S. Supreme Court's refusal a month ago to review an appellate case overturning Virginia's gay marriage ban.

And this one is at its end. Kansas had appealed it ruling to the SCOTUS and Justice Sotomayor did grant them a very short stay , which expired. Then the state asked the entire court for a stay ( I think, I am a little big fuzzy on this one ) and ONLY Scalia and his sock puppet Thomas dissented the opinion of NOT granting the stay ! 
We want to read from these tea leaves that the ruling in the 6th circuit case is going to be 7-2 ! This one is instant, they are out of wiggle room, marriages would have started today if the local offices did not close at 4. 

ALSO! ( a big day in the gay ) the case in MISSISSIPPI for marriage equality before US district judge Carlton Reeves wrapped up today. No word on when the ruling will come down but most court watchers say the case has gone our way.
