For the news obsessed homos out there, this has been coming down the pipeline for a year or so, slowly, molasses in January slow.. crossing t's and dotting i's. Freedom isn't free and all that sort of thing. And the Internet rumors had been up and down for weeks, TOMORROW! for sure, this time. My husbands , cousins, friends hairdressers brother works for Judge Walker...but, we found out Tuesday that , sure enough tomorrow was May 17th, 1954, maybe.

Everyone knowing that for the most part the " gays are icky" defense of Prop 8 had just been so unbelievably weak, that the Bush I appointed Judge would not, could not have any other choice but to find in favor or Ms. Perry , the wonder team of Olson and Boies had brought it home. Tick, tick , tick...
Joe Jervis , over at his wonderful and daily quoted here on the k+b, blog, Joe.My.God. became the de facto clearing house. " We gather together...", at one point, his blog, which gets a zillion hits and comments a day, went quite, not a single comment for a couple of hours before the ruling came out, we were all just there, on the edge of our seats. I had a live feed from Ch 7 in San Francisco, which was just a camera pointed at the crowd gathered at the court house. NYT, HUFFINGTONPOST, TOWLEROAD, refresh, refresh, refresh.
Then around 4:30 it appeared that someone at of all places New York Magazine really did have the husband's, cousin's , friend's hairdresser.... because they were the first one to leak, a good half an hour or so before anyone else that YES, indeed , it was time to pop those Champagne corks! Gay daddy bear Judge Vaughn Walker had SPANKED the dumb as a sack of hammers right wing haters and had come down from the mountain top with the big one. Not a minor , " oh please sir, may I have a wedding " , but a great big heaping bowl of " get the fuck out of the way Mormon Church and Tony Perkins, we are having a throw down tonight"

No credible evidence supports a finding that an individual may, through conscious decision, therapeutic intervention or any other method, change his or her sexual orientation. (FF #46)

Domestic partnerships lack the social meaning associated with marriage. (FF #52, p. 80)
Proposition 8 has had a negative fiscal impact on California and local governments. (FF #64, p. 90)
Gays and lesbians have been victims of a long history of discrimination. (FF #74, p. 96)
Religious beliefs that gay and lesbian relationships are sinful or inferior to heterosexual relationships harm gays and lesbians. (FF #77, p. 101)

"Judge Walker's ruling overturning Prop 8 is an outrageous disrespect for our Constitution and for the majority of people of the United States who believe marriage is the union of husband and wife. In every state of the union from California to Maine to Georgia, where the people have had a chance to vote they've affirmed that marriage is the union of one man and one woman. Congress now has the responsibility to act immediately to reaffirm marriage as a union of one man and one woman as our national policy."

Wife #1.. who you make sign the divorce papers while lying in the hospital bed eaten up with some nasty cancer , to be with the woman you were cheating on her with. Wife #2 is by your side as you scream and yell about Bill Clinton being a cheat and all WHILE already banging wife #3. This one I take personally, " The Homosexuals want to destroy the church". Really, Pat, you vile piece of rotting bat shit? THE GAMBLER
One of my favorite parts of the aftermath was the HRC being omnipresent getting all roostery and crowing about this v-i-c-t-o-r-y! When at the beginning of the trial when Olsen and Boies started this, were all timid and head in the sand about it, " oh, no, wait, don't be bold.. we might offend " , but come up out of the floorboards to take a little credit where none was due. Good job guys , way to have a little balls faith.
There is no question that this is a HUGE gamble. Really.
The four horseman -Roberts, Scalia , Scalia two..errrr, Thomas, and Alito - could EASILY stick to their Roman Catholic dogma and allow that " gays are icky" is a perfectly valid legal point. Stare Decisis and Bowers v Hardwick and Lawrence v Texas ( even Loving v Virginia) be damned!
BUT, the tri-6 bearing Justice Scalia himself stated that : " Lawrence v Texas can and will lead to full out groom on groom dancing and the gay marriage " or , you know, something close to that.
So, it's back to the waiting game.
There was , as there seems to always be, a little cloud in our silver lame lining. Justice Walker put a stay on his own ruling and gay marriages will not take place there in California for a bit, .. just giving both sides time to get the appeals all up and running. Smart move.. cautious move. BUT, in a surprise stance by both the Governor of California and it's non billionaire Governor wanna be , Schwarznegger and Brown have sued to get marriages happening again ASAP!
From the Sacramento Bee : " In an extraordinary court filing, Gov. Arnold Schwarzenegger asked Friday that gay marriages be allowed to resume immediately in California after a federal ruling that the state's voter-approved ban on gay marriage is unconstitutional." ( the rest )
So, there you have it, Prop 8,( ←watch this one) the never ending story. I will do my best to keep you abreast of the goings on.. since I do know many of you have those " lives" things and don't live and breath this stuff. Liberty and Justice for who ?.....yeah, baby.
