I've been holding off on writing this , because there are all these FACT things, and all this legal reading to do that , well, just hurts my pretty little head, AND the Athens paper has been printing all these pictures from UGA Sorority Rush, 2010, and Jodi and I have been ripping girl's dresses... you know, " old times here are not forgotten" and all. So, I have been busy....

Thursday was another one of those nail biting , web surfing , will he or won't he days. Hot big daddy bear, Judge Vaughn Walker - hitherto knows as HBDBJVW - was going to burning bush his week long stay on the gay marriage. LINES were forming all over the Golden State, as same sex couples were ready to jump that broom, tie that not, walk down that aisle, or at least pay that 22 bucks to the clerk. Let Freedom Ring...

Between 9 and noon west coast time, or something like that, .. so , just like the original ruling , we all wait. Now, here at the k+b, we have sort of joined this little mish mash of an online blogging family, all of us viewing , reading the exact same source material, all of us wanting the same outcome. I am sure the haters have the exact same , just with rotary telephones.
I was watching feed from some San Francisco tv station, had Joe, the SF Chronicle, and the LA Times and Huffpo pulled up, with trips to CNN and Butt Boy Matt just to double check my facts. HEY! My journalistic roots run deep, I lived with Special to the Red and Black B. Day, I'm, like, the vintage Woodward and Bernstein, ( not the crap media whores they have become today, I'm talking the real ones, Redford and Hoffman years..) Kyle R. Murrow, at your service.
Buzz, buzz , buzz.. trickle trickle trickle, .. "THE JUDGE RULES AGAINST IT!"
facebooked blog god, JMG. YEAH !!.... right? Confusion ruled the blogosphere as everyone grappled with the exact same five words...(aka You can't put too much water into a nuclear reactor ...)
WE WIN ! *
Turns out the ruling was against the continuation of the stay, so it was a good thing, except with everyone, and I do mean everyone, reading the exact same facts, things got a little bit out of hand. Joe had some sort of mole ( really, a blog mole! I am guessing just as gay as Anderson.) inside the Court House, who read the first page and tells Joe : " Throw the rice Mary Lou, Mama's coming home with a wedding ring tonight ". Weddings can start RIGHT NOW....
BUT, once again crossing t's and dotting i's HBDBJVW was getting all the legal ducks in a row, and lifting the stay on the 18th, at 5:30 - MAKING SURE that all parties concerned had all the time they need to rush off to Kinko's and get what ever it is they need to do , done... all of it a wise and good move on his part. So, a little bit of : premature bloggulation ( as he put it ) but ALL IS WELL, hopefully.

THINGS GET FUZZY

Ok, So now it's Friday morning. Maybe more late night Thursday, but post jubilation, and things are starting to fall in place. The Gay Haters are rushing off , with a fresh mimeograph high to the 9th circuit court of appeals to get the stay, set by HBDBJVW, to well... stay. For some reason, all the legal language and how's and why's are just hard to stick in my brain. But here is the bottom line. The case is PERRY v SCHWARZENEGGER. meaning the gays wanting to get married v The State of California, Arnold baby, Governor. got it?
OK, two. Governor Schwarzenegger AND Attorney General Brown CHOSE NOT TO BE A PART OF THE CASE.. they agreed with Ms Perry, that her Federal rights had been violated. That, to me, has seemed confusing from the get go. So, all the parties concerned got together and threw the doors open for all that Mormon and Catholic money , the NOM crowd to come in and prove their point. Which they failed at , miserably! ( again, gay is icky, is NOT a legal argument ) So, the people arguing that no one's Federal rights had been violated, were NOT part of the case....see, its complex.
So, just how smart/clever/devious are Olsen/Boies/Reiner and Walker?
The people ,The State of California, lost the case, which The State of California is just fine with, really. So, the Ninth Circuit Court of Appeals is hearing an appeal from some guy off the street ... get it ? A guy with no standing in the case, just someone that really , really hates the gays. They were pretty much set up from the get go... and , as far as my tiny legal brain can figure out, this is the end, or will be the end of Prop 8 . So, not with a bang, but a whimper ( again ).

But wait, there's more....

From Courage Campaign : "The Ninth Circuit just issued an Order stating that the Plaintiffs’ response to the Motion to Stay is due by 11:00 p.m. tonight.( Friday ) The Prop 8 supporters’ reply, not to exceed 15 pages, is due by 9:00 a.m. on Monday, August 16, 2010. This suggests that the Ninth Circuit is preparing to rule on the Motion to Stay before Judge Walker’s temporary stay expires on August 18th at 5:00 p.m. It’s surprising that the Court only gave the Plaintiffs about 9 hours to file their brief, and gave the Appellants until Monday to Reply. But I wouldn’t read too much into this. They know that everyone anticipated the Motion and that everyone’s briefs are essentially written already."
The notoriously liberal 9th Circuit, just wants this done. From the looks of things, and I have read , a lot on this, it's wham bam thank you mam, get me to the church on time. I guess. Meaning that the Supreme Court will have nothing at all to do with this case... ( that is a great big I guess.. there is some complex legal stuff going on here) and AND the case they will here is the MUCH more winnable Gill et al. v. Office of Personnel Management. Which has the haters in a panic.

All of this is not happening, in a vacuum. The longer this drags out the more and more your Joe Q. Public , #1, gets really tired of hearing about it, and #2, is sort of at the point of wondering what exactly the big deal is. So, two guys get married, big whoop... Even King Crazy Glen Beck was all "meh" about it this week.

And so it goes.....
